​As of April 9, 2025, there are no recent reports indicating that the Supreme Court has stated that criminality cannot be attached to a West Bengal Cabinet decision as it would be against federalism. However, in May 2024, the Supreme Court addressed issues related to federalism and the Central Bureau of Investigation’s (CBI) jurisdiction in West Bengal. The Court emphasized that law and order is a State subject and upheld the maintainability of West Bengal’s suit challenging the CBI’s investigations within the state without prior consent. These discussions pertained to the CBI’s authority and the state’s autonomy, rather than any specific Cabinet decisions by the West Bengal government.​
