The Delhi High Court has set aside an interim order that previously restrained the law firm Fox Mandal & Associates, managed by brothers Shuvabrata and Shouryabrata Mandal, from using the ‘FoxMandal’ trademark. This trademark is claimed to be owned by their brother, Som Mandal, who operates a separate firm, Fox Mandal & Co .
On May 28, 2025, a division bench comprising Justices C Hari Shankar and Ajay Digpaul quashed the earlier order issued by a commercial court. The High Court emphasized that this decision was made without expressing any opinion on the merits of the case and directed both parties to submit their respective pleadings by early June. The commercial court is scheduled to hear the matter on June 6 .
The initial injunction, granted on May 15 by District Judge Vidya Prakash at Patiala House Courts, was based on Som Mandal’s claim that his brothers’ use of the ‘FoxMandal’ name and domain (www.foxmandal.in) infringed upon his firm’s registered trademark and could potentially mislead clients. Som Mandal asserted that he has been managing Fox Mandal & Co since 1989 and had registered the ‘FOXMANDAL’ trademark in 2002. He alleged that his brothers began using a similar name and logo, leading to confusion .
The High Court’s decision to set aside the interim order allows Fox Mandal & Associates to continue using the ‘FoxMandal’ name temporarily, pending the commercial court’s final decision on the matter.
