Supreme Court judgment on contempt.
News SCC ONLINE, HINDUSTAN TIMES, THE PRINT, the week
As of today, April 25, 2025, there is no available news confirming that the Supreme Court has issued a ruling stating that when one judge of a High Court holds a party guilty of contempt, another judge of the same High Court cannot take a contrary view. However, there have been instances where the Supreme Court addressed issues related to conflicting orders within the same High Court.
For example, in July 2024, the Supreme Court intervened when two different benches of the Delhi High Court initiated contempt proceedings concerning the felling of trees in the city’s ridge area. The Supreme Court emphasized the importance of judicial propriety and expressed concern about the potential for conflicting orders. The Court suggested that it would have been more appropriate for the second bench to seek clarification from the Chief Justice of India before initiating contempt proceedings for the same cause of action .
Additionally, in a separate case involving the Punjab and Haryana High Court, the Supreme Court expunged “gratuitous” remarks made by a judge criticizing the Supreme Court’s stay on contempt proceedings. The Supreme Court advised High Court judges to exercise greater restraint and cautioned against undermining the hierarchical structure of the judiciary .
These instances highlight the Supreme Court’s role in maintaining consistency and propriety within the judicial system, especially when conflicting orders arise within the same High Court.
