On April 23, 2025, the Supreme Court of India clarified the application of Order 41 Rule 31 of the Civil Procedure Code (CPC) in appellate proceedings. The Court held that an appellate court is not obligated to frame specific points of determination under this rule if the appellant has not raised any particular issues for reconsideration. The judgment emphasized that the appellant must demonstrate that the trial court’s decision was erroneous on specific grounds; only then does the appellate court need to address those points in its judgment.
The Court’s decision overruled a judgment by the Allahabad High Court, which had invalidated an appellate court’s decision solely due to the absence of framed points of determination. The Supreme Court observed that non-compliance with the rule does not automatically vitiate the judgment if there has been substantial compliance and the appellant has not presented specific issues requiring reconsideration.
This ruling aligns with the Court’s earlier decision in Thakur Sukhpal Singh v. Thakur Kalyan Singh (1963), which held that the requirements of Order 41 Rule 31 apply only when the appellant raises specific points for determination. If no such points are raised, the appellate court may dismiss the appeal succinctly.
