On May 16, 2025, the Patna High Court delivered a significant judgment emphasizing the reformative nature of the Juvenile Justice (Care and Protection of Children) Act, 2000. Justice Jitendra Kumar set aside the conviction and sentence of a juvenile under the Arms Act, highlighting that the Act is grounded in the belief that children are the future of society and should be reformed and rehabilitated, not punished. The Court noted that a punitive approach towards children in conflict with the law would be self-destructive for society, as reflected in the preamble and provisions of the Act.
The juvenile in question, nearly 17 years old at the time of apprehension, was convicted by the Juvenile Justice Board and sent to a Special Home for three years. The High Court found that the prosecution failed to prove the recovery of arms from the petitioner beyond reasonable doubt, as the seizure witnesses provided inconsistent testimonies and lacked proper documentation. Consequently, the Court concluded that convicting the juvenile on such unsubstantiated evidence would be a travesty of justice.
This ruling underscores the judiciary’s commitment to upholding the rehabilitative objectives of juvenile justice laws, ensuring that children in conflict with the law are treated in a manner that promotes their reintegration into society.
