As of April 5, 2025, there are no reports of a High Court quashing a preventive detention order in today’s news. However, in recent months, several High Courts and the Supreme Court of India have addressed and overturned preventive detention orders:
- Supreme Court’s Stance on Preventive Detention: In March 2025, the Supreme Court described preventive detention as a “draconian measure” and quashed detention orders against individuals involved in a narcotics case, citing the lack of prescribed safeguards.
- Jammu and Kashmir High Court’s Decision: Also in March 2025, the Jammu and Kashmir High Court overturned the preventive detention of Nazir Ahmad Ronga, a former president of the Jammu and Kashmir High Court Bar Association. The court found the allegations against him to be vague and lacking specific material evidence.
- Bombay High Court’s Rulings: In January and February 2025, the Bombay High Court quashed preventive detention orders in two separate cases:
The detention of a 20-year-old Beed resident involved in Maratha reservation protests was overturned due to constitutional violations and procedural lapses.
he court also nullified the detention of a Nanded resident accused of extortion, stating that mere possession of a weapon does not necessarily indicate a public order issue.
These decisions underscore the judiciary’s commitment to safeguarding individual liberties and ensuring that preventive detention is not misused without proper justification.
