On May 8, 2025, the Supreme Court of India delivered a landmark judgment affirming that officers of the Military Nursing Service (MNS) are entitled to Ex-Servicemen (ESM) status under Punjab’s recruitment rules, thereby overturning years of administrative exclusion and setting a significant precedent for gender equity in the armed forces .
The case centered on Captain Gurpreet Kaur, a retired Short Service Commissioned Officer from the MNS, who had applied for the Punjab Civil Services (PCS) Examination in 2020 under the ESM category. Her application was rejected by the Punjab Public Service Commission, which cited guidance from the Kendriya Sainik Board stating that MNS officers did not qualify as ESM under the Central Ex-Servicemen Amendment Rules of 2012.
Captain Kaur challenged this decision in the Punjab and Haryana High Court, which ruled in her favor, stating that under the Punjab Recruitment of Ex-servicemen Rules, 1982, she qualified as an ex-serviceman. This decision was subsequently contested in the Supreme Court by another candidate, Ms. Irwan Kour, who had also applied under the ESM category.
The Supreme Court upheld the High Court’s decision, emphasizing that the restrictive interpretation of rules denying ESM status to MNS officers was discriminatory and could deter youth from joining the defense forces. The Court highlighted that such practices, especially in states like Punjab, which contribute significantly to the military, would be discouraging.
This judgment not only rectifies a longstanding injustice faced by MNS officers but also underscores the need for inclusive policies that recognize the contributions of all military personnel, regardless of gender. It calls attention to the importance of revising outdated terminologies and ensuring that administrative practices align with the principles of equality and fairness.
