KARNATAKA HIGH COURT BATS FOR UCC SAYS WILL ENSURE GENDER JUSTICE FOR ALL .

​The Karnataka High Court has recently advocated for the implementation of a Uniform Civil Code (UCC) in India, emphasizing its potential to ensure gender justice and equality across all communities. Justice Hanchate Sanjeevkumar highlighted that enacting a UCC would uphold the constitutional principles of justice, liberty, equality, and fraternity, thereby strengthening the nation’s democratic and secular fabric.

This recommendation emerged during a case concerning the inheritance rights of a deceased Muslim woman, Shahnaz Begum. The court observed disparities in inheritance laws between different religions, noting that while Hindu law grants equal rights to sons and daughters, Muslim law does not afford the same equality between brothers and sisters. Justice Sanjeevkumar pointed out that such inequalities underscore the necessity for a UCC to provide uniform rights irrespective of religious affiliations.

The court has directed that copies of its judgment be forwarded to the principal law secretaries of both the central and Karnataka state governments, urging legislative action towards formulating and implementing a UCC. ​
