Judge dismissed for bail order.

On May 6, 2025, the Madhya Pradesh High Court provided relief to former Additional District and Sessions Judge Roop Singh Alava, who had been dismissed from service in 2012 for granting bail to a murder accused. The court determined that his action constituted an “error of judgment” rather than “serious professional misconduct.”
Judge Alava had granted bail to an accused who had previously been denied bail four times by the High Court. Despite a directive to expedite the trial within six months, Alava granted bail in November 2012. This led to his dismissal based on allegations of granting bail for corrupt or extraneous considerations.
In its ruling, the High Court acknowledged that while the bail order was “erratic,” it did not amount to major misconduct. Considering Alava’s unblemished 28-year service record and the absence of any proven corruption, the court deemed dismissal excessive. Instead, it reduced the penalty to the withholding of two annual increments, noting that Alava had already reached retirement age in 2018 .
This decision underscores the principle that judicial errors, absent evidence of malintent or corruption, should not automatically result in the harshest disciplinary actions.
