On June 6, 2025, the Jammu and Kashmir High Court granted a two-year extension to a previously issued building permission, acknowledging that the appellants were unable to commence construction due to an interim stay order. The court emphasized that parties should not suffer due to circumstances beyond their control, such as judicial orders. Consequently, the Municipal Committee Hajin was directed to issue a formal extension based on the original permission dated August 6, 2021, maintaining all its original terms and conditions .

The appellants had approached the court after the original building permission expired, arguing that the interim stay during the pendency of the writ petition had prevented them from utilizing the two-year window for construction. The court observed that the appellants could not be made to suffer for something they had not done and extended the building permission by two years.

The court’s decision underscores the principle that parties should not be penalized for delays caused by judicial processes, ensuring that their rights are protected even when external factors impede their ability to act.
