ISSUE GUIDLINES REGULATING SPAS MASSAGE CENTRES & CROSS GENDER MASSAGES : STATE GOVT TO BOMABY HC

​In January 2025, the Maharashtra government informed the Bombay High Court that it had no objections to permitting cross-gender massages in spa centres across the state. The government also indicated its intention to formulate guidelines to regulate the operations of spas, massage centres, therapy, and wellness centres.

This development arose from a petition filed by 11 therapists who reported harassment and humiliation due to police raids and actions under the Immoral Traffic (Prevention) Act, 1956. They contended that such actions infringed upon their rights to livelihood, dignity, and equality.

During the court proceedings, the Advocate General acknowledged that while police interventions typically follow complaints from neighbors, there was merit in establishing clear guidelines to balance public interest with the rights of spa owners and therapists. He referenced the Delhi government’s existing guidelines for spa and massage centres as a potential model, noting that the Delhi High Court had stayed a clause prohibiting cross-gender massages. He expressed that, in contemporary times, cross-gender massages should not be contentious.

Consequently, the Bombay High Court granted the Maharashtra government six weeks to draft appropriate guidelines for the functioning of spa and massage centres. These guidelines aim to protect the rights of therapists while addressing public concerns.

As of March 24, 2025, the specific details of the proposed guidelines have not been publicly disclosed. However, it is anticipated that they will be informed by existing frameworks, such as those implemented by the Delhi government. The Delhi guidelines include provisions like banning sexual activities on premises, prohibiting the employment of individuals under 18, requiring separate sections for men and women, and mandating police verification of staff. ​

The Maharashtra government’s forthcoming guidelines are expected to address these aspects to ensure the safe and regulated operation of spa and massage centres in the state.​
