Controversy Over Allahabad HC Ruling: Supreme Court Urged to Review Decision in Minor’s Sexual Assault Case

​As of now, there are no reports indicating that the Supreme Court has stayed the Allahabad High Court’s ruling regarding the case where the accused allegedly grabbed a minor girl’s breasts and broke the string of her pyjama. The Allahabad High Court had determined that these actions did not constitute an attempt to rape but rather amounted to aggravated sexual assault under Section 354-B of the Indian Penal Code and Sections 9/10 of the Protection of Children from Sexual Offences (POCSO) Act.

This decision has faced criticism from various quarters. Union Minister for Women and Child Development, Annapurna Devi, expressed strong disagreement with the verdict, stating that it could send a negative message to society. She urged the Supreme Court to take serious note of the matter, emphasizing that such a ruling has no place in a civilized society.

Similarly, Rajya Sabha MP and former Delhi Commission for Women chief, Swati Maliwal, described the High Court’s observation as dangerous for society and called for Supreme Court intervention.
