On May 16, 2025, Chief Justice of India (CJI) BR Gavai publicly criticized the Supreme Court Bar Association (SCBA) and the Supreme Court Advocates-on-Record Association (SCAORA) for not organizing a customary farewell for retiring Supreme Court judge Justice Bela M. Trivedi. Justice Trivedi, who was the eleventh woman to serve on the Supreme Court, retired on that day, marking the end of a distinguished judicial career.
During a ceremonial bench held to honor Justice Trivedi, CJI Gavai expressed his disapproval, stating, βI must deprecate openly,β regarding the associations’ decision to forgo the farewell. He emphasized the importance of adhering to judicial traditions, noting, βOn such occasions, such a stand ought not to have been taken by the Association.β CJI Gavai acknowledged the presence of SCBA President Kapil Sibal and Vice-President Rachna Srivastava, commending their attendance despite the associations’ stance. He remarked that their presence underscored the respect and recognition Justice Trivedi deserved.
The controversy stems from certain sections of the legal community who objected to Justice Trivedi’s decisions, including a notable ruling last year where she ordered a Central Bureau of Investigation (CBI) inquiry into the filing of a petition based on allegedly forged documents. These decisions reportedly led to tensions between Justice Trivedi and some members of the bar associations, contributing to the decision not to hold a farewell ceremony.
In response to the situation, the Bar Council of India (BCI) issued a letter urging the SCBA and SCAORA to reconsider their decision and honor Justice Trivedi with a farewell, emphasizing that such ceremonies are vital for upholding judicial traditions and respect within the legal community.
This incident highlights ongoing tensions within the Indian legal community regarding adherence to traditions and the relationship between the judiciary and legal professional bodies.
