The Kerala High Court has directed both the State and Central governments to take urgent action—including seeking compensation and safeguarding marine life—following two consecutive maritime disasters off the Kerala coast. The plea, filed by former MP T.N. Prathapan, now includes the recent fire aboard MV Wan Hai 503 near Kannur, in addition to the earlier sinking of MSC ELSA 3 off Alappuzha. The court highlighted that available legal frameworks—under the Admiralty Act, Admiralty jurisdiction, and international conventions—empower authorities to file suits, arrest sister vessels, and recover cleanup costs from shipping companies rather than relying on public funds.
It underscored that any delay in enforcing these measures could establish a detrimental precedent. Simultaneously, the court has instructed the Kerala government to publicly disclose full cargo manifests, environmental impact assessments (including the presence of calcium carbide, plastic nurdles, hydrazine, slaked lime, and other hazardous materials), and details of cleanup operations—aiming for transparency and ecological restoration.
Further, a scheduled hearing on June 19 will likely address directives for filing legal suits, arresting vessels, appointing an amicus curiae, and ensuring timely relief for affected fishermen and residents.
