The Supreme Court of India has agreed to hear next week a plea challenging demolition notices issued for certain properties in Delhiās Jamia Nagar area, specifically in Batla House. This decision follows concerns raised by residents and their legal representatives about the legality and procedure of the demolitions.
On May 8, 2025, the Supreme Court directed the Delhi Development Authority (DDA) and the Delhi government to remove unauthorized constructions over more than 4 bighas of public land in Khasra No. 279, Okhla Village, within three months, in accordance with the law. Subsequently, demolition notices were issued to several properties in the area, including those in Khasra Nos. 277 and 279.
Residents claim that the demolition notices, pasted on May 26, provided no opportunity for a hearing, despite the Supreme Court’s earlier direction that a 15-day prior notice be given before any demolition. They argue that the demolitions are being carried out arbitrarily and without following due process.
During a hearing on May 29, 2025, a counsel representing the affected residents mentioned the matter before Chief Justice of India BR Gavai, seeking urgent listing. Initially, CJI Gavai advised approaching the Delhi High Court. However, the counsel contended that since the demolition orders stemmed from a Supreme Court directive, the High Court would not have jurisdiction. He further argued that the affected parties were not heard before the demolition orders were passed.
After considering the submissions, the Supreme Court agreed to list the matter for hearing next week.
Residents have expressed hope that the Supreme Court will provide relief and ensure that due process is followed before any demolition is carried out.
