On May 26, 2025, the Supreme Court of India ruled that the prosecution may be permitted to submit documents omitted from the original chargesheet, provided the omission was bona fide and does not prejudice the accused. This decision was rendered by a bench comprising Justices Abhay S. Oka and A.G. Masih.

The case involved the prosecution’s attempt to introduce Compact Discs (CDs) during trial, which were referenced in a supplementary chargesheet but not submitted to the magistrate. The magistrate allowed their production, a decision upheld by the High Court. The accused challenged this in the Supreme Court, arguing that Section 173(5) of the Criminal Procedure Code mandates the submission of all relevant documents with the chargesheet.

The Supreme Court, however, held that Section 173(5) is directory, not mandatory, and that omissions can be remedied post-chargesheet if no prejudice is caused to the accused. The Court emphasized that procedural lapses should not obstruct justice, especially when the defense retains the right to challenge the authenticity of such evidence during trial.

This ruling clarifies that courts have discretion to allow the prosecution to submit additional documents after filing the chargesheet, ensuring that justice is not hindered by procedural oversights.
