The Bombay High Court has recently criticized the Brihanmumbai Municipal Corporation (BMC) for its inaction regarding the demolition of an illegal hall in Mumbai. In a ruling dated March 10, 2025, the court directed the BMC to demolish the unauthorized structure, which was constructed without municipal approval on encroached land owned by New Shri Swami Samarth Borivade Housing Company Private Limited. Despite a previous directive on January 27, 2025, the BMC had failed to fully implement the order, citing resistance from local residents. The court emphasized that in a democratic country, no organization or individual has the right to defy or oppose the law.
This ruling underscores the court’s commitment to ensuring that unauthorized constructions are promptly addressed, regardless of local opposition.
