Allahabad High Court Upholds Seriousness of Rape & Forced Conversion Allegations, Rejects Plea for Case Dismissal!

​The Allahabad High Court has recently addressed multiple cases involving allegations of rape and illegal religious conversion, underscoring the judiciary’s commitment to thoroughly examining such serious charges.​

Case 1: Dismissal of Plea to Quash FIR Against 37 Individuals

In February 2023, a Division Bench comprising Justice Anjani Kumar Mishra and Justice Gajendra Kumar dismissed a petition seeking to quash an FIR against 37 individuals accused of coercing a man into converting from Hinduism to Christianity through inducements. The court emphasized that the FIR contained elements of a cognizable offense and warranted a comprehensive investigation. The judges highlighted that the FIR was filed by a competent individual and that dismissing it prematurely would be inappropriate.

Case 2: Denial of Bail in Rape and Forced Conversion Allegations

In a separate case, the High Court refused bail to Farhan Ahmad, also known as Sanu, from Gorakhpur. He was accused of raping a woman under the false promise of marriage and subsequently pressuring her to convert to Islam. Justice Om Prakash Tripathi, while rejecting the bail application, noted the gravity of the allegations and deemed it inappropriate to grant bail at that stage. The court underscored that engaging in sexual relations under the pretext of marriage could constitute rape, and such serious allegations necessitate a thorough judicial process.
