Highcourt oks MTP for 2, asks Jj Hasp board to suggest method.

​In a recent development, the Bombay High Court authorized a medical termination of pregnancy (MTP) after 35 weeks of gestation. The court’s decision was influenced by a report from the medical board of J J Hospital, which unanimously recommended the termination. The board highlighted that the fetus suffered from congenital macrocephaly (an abnormally large head) accompanied by a brain defect. They noted the possibility of the fetus being born alive, necessitating a neonatal intensive care unit (NICU) stay, and anticipated severe health challenges, including drug-resistant seizures, developmental delays, intellectual deficits, and poor vision, rendering the baby’s life expectancy and quality of life severely compromised. ​

The court emphasized the woman’s right to reproductive autonomy and bodily integrity, taking into account her medical condition and the medical board’s findings. Consequently, the court permitted the MTP procedure to be performed at a private hospital, as recommended by the medical board.

This case underscores the judiciary’s recognition of a woman’s sovereign right to make decisions regarding her reproductive health, especially when severe fetal anomalies are detected late in pregnancy.
